Trial and Case Highlights

• In an insurance bad faith case, Brad obtained a directed verdict, at the close of Plaintiff’s case, in plaintiff’s oriented eastern Kentucky court wherein the last demand by the plaintiff was $7.5 million.

• In another insurance bad faith case, the plaintiff asked the jury for $7,000,000 in damages in a very plaintiff-oriented venue and sought $3,000,000 to settle just before trial. At trial, the jury came back with a verdict of $923,000 for the bad faith.

• In a first party UIM suit, the plaintiff sought approximately $1,700,000 in total damages at trial.  Well before trial, Brad sent Plaintiff’s counsel an offer of judgment for $45,000, which is in addition to a 25k underlying limit and 10k PIP offset.  The jury verdict came in at approximately $72,000.  Therefore, the plaintiff had to pay the insurance company’s trial expenses and costs.

• In a trial of an automobile accident case, the plaintiff asked the jury for $630,000 in damages ($70,000 in past medical expenses, $140,000 for future medical expenses, and$420,000 for pain and suffering). The primary liability defense our team presented to the jury was that there was no evidence that our insured had anything other than a green light as he entered the intersection. After deliberating for 25 minutes, the jury returned a unanimous defense verdict.

• Brad obtained a defense verdict on a social host liability case wherein the plaintiff was beat up at a party at the defendant’s home. At the time there was no law in the State of Kentucky on private individuals and their duties when alcohol is being served. Brad’s defense was that the dram shop laws did not apply to a situation where the host was serving alcohol in a social capacity and not-for-profit. After the case went up on appeal, and the Court of Appeals also agreed with Brad, it became a recorded decision in the Law of Kentucky.

• In a multimillion-dollar product liability case and on the second day of trial, the judge recommended to Plaintiff’s counsel that the plaintiff accept whatever the defense offered.  Thereafter, plaintiff accepted the cost of the appeal.

• In a medical malpractice claim, plaintiff sought $7,200,000 for an injury to a shoulder. After a short trial of 3 days, the jury came back with a defense verdict on liability in approximately 24 minutes.
